REINSW warns Government regarding Swimming Pools Regulation

REINSW has lodged a submission in response to the Draft Swimming Pools Regulation 2018 (NSW) and Regulatory Impact Statement.

REINSW works to promote the interests of its members and the property sector, and plays a critical role in the formation of regulatory policy in New South Wales.

The Swimming Pools Regulation 2008 is scheduled for automatic repeal on 1 September 2018. It proposes that the Swimming Pools Regulation 2018 (proposed) retains many of the existing provisions, while making updates to improve safety.
REINSW is concerned the date of commencement of the Draft Regulation leaves little scope for the effective consideration of submissions. It also raises key safety issues regarding display of warning notices (CPR information), the definition of the term “spa pool” and the enforcement mechanisms of non-compliance.

The proposed changes relevant to the real estate industry include:
  • Imposing a new obligation on occupiers to display a warning notice while a swimming pool is being constructed, and making it an offence to fail to comply with that obligation
  • Changes to warning notices that are already required to be displayed under the Act
  • Requiring certificates of non-compliance to be entered into the Swimming Pools Register
  • Introducing greater flexibility for the way in which spa pools can be secured
  • Clarifying compliance with applicable standards as well as the Building Code of Australia Performance Requirements

REINSW supports the Government’s initiatives and reasons behind the Draft Regulation and is working with Government to improve safety and establish standards.
